Privacy Notice

The Cash Register Doctor Ltd, trading as TotalPOS Solutions, and TotalPOS Rentals Ltd (collectively referred to as “TotalPOS”, “we”, “us” or “our”) provide products and services solely to businesses and other organisations located in New Zealand and we comply with the privacy laws of New Zealand. We respect your right to privacy and will safeguard your personal information. This privacy notice sets out how we handle personal information collected by us when you visit or use any of our websites or interact with us in any other way.

Please note that any information collected by any other websites that are linked from any of our sites is not subject to this Privacy Notice. 

1. Information collected by us

We may collect personal information when you: 
a. visit any of our websites and/or complete any type of form on any of our websites, 
b. contact us by visiting one of our offices or by email, phone, or any other means, 
c. request a quotation or any other information or book any of our services, 
d. purchase, lease or rent any of our products or services, 
e. apply to open an account with us or update details for an existing account, 
f. complete a survey at our request. 

This information may include: 
a. personal identification and documents such as your full name, date of birth and postal/residential address, and/or a copy of your driver’s licence or passport, 
b. financial information such as bank account number, credit card number (including expiry date and CVV number), billing address, 
c. information collected automatically from our websites including your domain name, your IP address, browser type, geographical location and any referring URL.

2. How we use your information

We will only use any personal information collected by us for our own legitimate business purposes which may include: 

a. providing you with our products and services and any related information including  quotations and support services, 
b. providing you with news and updates regarding new products, security or other threats which may affect you, optional or mandated upgrades to products you may already have, changes in our company, and new policies which may affect you or your business, 
c. maintaining your account and other records with us including collection of any amounts owed to us, warranty details, product recalls etc., 
d. conducting credit checks, 
e. responding to enquiries from NZ government organisations, or any other party with the legal authority to request such information, 
f. establishing and maintaining merchant services or any other third party services provided to you by us. 

3. How we share your information

Your information may be shared with: 

a. employees of The Cash Register Doctor Ltd, trading as TotalPOS Solutions,  
b. third party hardware, software and service providers for the purposes of supplying  and maintaining our products and services, 
c. debt collection and credit agencies, 
d. other service providers such as courier companies, 
e. NZ government and other organisations with the legal authority to request such information, 
f. any party who has signed a non-disclosure agreement requiring that they only use your personal information for the purposes contained in this Privacy Notice, 
g. any other person or party where you have provided your specific consent. 

We do not sell your personal information. 

4. How we store and safeguard your personal information

a. Your personal information is stored securely as part of our password-protected ERP and CRM systems with the same level of security that we use for our own confidential information.  
b. Some of your personal information may be stored or processed using reputable cloud-based service providers located outside of New Zealand, such as in Australia or the United States. We take reasonable steps to ensure these providers have privacy safeguards that meet or exceed the standards required by New Zealand law. 
c. We have policies and procedures in place to prevent accidental or unauthorised use or disclosure of your information. 
d. Your personal information will be deleted from our records once we no longer need to retain it for commercial reasons or to comply with NZ government requirements.  

5. Your rights regarding your personal information

a. We comply with the provisions of the NZ Privacy Act of 2020 and any subsequent amendments or replacement legislation. 
b. In particular, you have the right to review any personal information we may hold about you and to request that we update it where necessary.  
c. You may request that we remove your email address from any marketing communications. 
d. Any communications regarding any aspect of this Privacy Notice should be emailed to privacy@totalpos.co.nz
